Equine Network, LLC (“EN”), with offices located at 7500 Alamo Rd NW Albuquerque, New Mexico 87120, desires to interview, record, film, photograph, and/or use provided/supplied photographs/videos of the individual named below, (“I” or “me”) in connection with Jumping Clinic with Beezie Madden (the “Work”), advertising and promotion of the Work, and advertising, promotional, and other commercial purposes.

For consideration which I hereby acknowledge, I irrevocably give EN my permission and grant to EN the right to interview, film, record, photograph me and/or use provided/supplies photographs/videos (the “Recording”) and to use the Recording and my name, likeness, image, photograph, voice, appearance, and other professional and personal characteristics and information (“Likeness”) in connection with the Work and the terms and conditions set forth in this Consent and Release (“Release”).

I hereby irrevocably grant and license to EN and EN’s affiliates, subsidiaries, licensees, distributors, agents, successors and assigns, (“Licensees”) the perpetual, worldwide right to display, publicly perform, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adapt, create derivative works, exploit, sell, rent, license, use and distribute, and permit others to use and distribute the Recording and the Work, including my Likeness as it appears in the Recording and all materials and media created by or on behalf of EN that incorporate my Likeness (”Materials”), in connection with the Work and for any purpose, including, but not limited to, advertising, publicity, and promotion of EN, and any other commercial purpose, in any media and format, on any platform, and by any and all technologies and means of delivery existing or created in the future, without further consent from or royalty, payment, or other compensation to me.

I understand and acknowledge that EN is the exclusive owner of all rights, title and interest in the Recording, Work, and Materials, including, but not limited, to all copyright rights and that they may only be used with the written permission of EN. I hereby (a) assign and transfer to EN, irrevocably and in perpetuity, throughout the world, my entire right, title, and interest, if any, in and to the Recording and Materials, including without limitation all intellectual property rights (which shall further include without limitation all registration, renewal and reversion rights); and (b) irrevocably waive any and all claims I may have now or in the future in any jurisdiction to so-called "moral rights" in the Recording and Materials. I acknowledge and agree that I have no right to review or approve the Work, Recording, or any Materials before they are used by EN or any other time, and that EN has no liability to me for any editing or alteration of the Work, Recording, or Materials or EN’s presentation of me. EN has no obligation to create or use the Work, Recording, or Materials or to exercise any rights given by this Release.

To the fullest extent permitted by applicable law, I hereby (a) irrevocably waive all legal and equitable rights relating to all claims, liabilities, losses, damages, demands, causes of action, and expenses including, without limitation, for libel, defamation, invasion of privacy or right of publicity, infringement of intellectual property rights, including but not limited to for copyright infringement, physical or emotional injury or distress, or violation of any other right or similar claim or cause of action under any legal theory (“Claims”), arising out of or relating, directly or indirectly, to EN’s or Licensee’s exercise of their rights under this Release and/or use of the Work, Recording, or Materials, (b) covenant not to make or bring any Claim against EN and any Licensee, and (c) forever release and discharge EN and the Licensees from liability under such Claims.

This Release is my complete understanding regarding the subject matter contained in it. If any term of this Release is held to be illegal or unenforceable, that term will be modified, but only to the minimum extent necessary to cure the defect, and the remaining terms will remain in full force and effect. All matters arising out of this Release will be governed by the laws of the State of Delaware without giving effect to its conflicts of law principles and I hereby irrevocably consent to the exclusive jurisdiction of the courts in New Castle, Delaware. This Release binds and inures to my benefit and the benefit of EN and our respective successors, assigns, and legal representatives.

I represent and warrant that I am at least 18 (19 if from Alabama or Nebraska, 21 if from Mississippi) years of age, have the right to contract in my own name, and that I have no pre-existing obligation that may restrict or limit my ability to sign this Release.
